IIK Scores Several Victories in the 2018 Legislative Session

IIK scored several legislative victories in the 2018 session of the Kentucky General Assembly. Bills on IIK’s agenda list that received final passage are as follows:

  • PIP Reform: We succeeded in adding a section to HB 464, a bill dealing with reinsurance, which requires that KY DOI conduct a study of PIP medical bill payments made to providers and compare those payments with the Workers Comp fee schedule and other similar payments. The study is to be completed by November 15, 2018.
  • Insurance Fraud Recovery: HB 323 sponsored by Rep. Steve Riggs (D-Louisville) deleted a provision in the insurance fraud statute barring civil recovery in the absence of a criminal conviction for insurance fraud. A prohibition on civil recovery in the absence of a criminal conviction is not generally found in law in KY, and it may have been unconstitutional.
  • Credit Balances on LGPT Returns: HB 402 sponsored by Rep. Jeff Greer (D-Brandenburg) represented a compromise struck between insurers represented by IIK and representatives of local governments. Prior to the passage of this bill, it was unclear whether or not the law required a refund of a credit balance of local government premium taxes that sometimes resulted when a specialty insurer had a large policy cancel in mid-term. The cancellation required a refund of remaining premium and tax to the policyholder and a credit balance on the return filed with the local government.
